This blog<\/a> is an initiative of the trade union federations in the Media, Arts and Entertainment sector, who are the European social partners representing workers in the sector across Europe and beyond. It is a sector where \u201catypical workers\u201d are a significant part of the picture in the labour market. Production and project-based working, as well as the wide range and diversity of workers involved in a given project, mean that multiple, short-term contracts and a variety of employment statuses are a common aspect of working in the sector. The concept of \u201catypical workers\u201d includes workers who are not hired in a conventional way with a labour law contract, but under civil or commercial law, as well as those working on short-term and part-time contractual arrangements, whether an employment or service-provision contract. Depending on the national context, this includes different types of workers, such as self-employed own-account workers (without employees), workers hired under authors\u2019 contracts, etc. These workers remain a vital part of the workforce in the sector and are highly flexible and highly skilled. Yet too often they remain vulnerable and inadequately covered by the protections offered to workers by labour law and conditions negotiated collectively. For trade unions they are a core, but sometimes hard to reach, group.<\/p>\n

In recent years, we have developed an ongoing reflection in the framework of our joint project work on how trade unions may meaningfully represent this workforce and uphold their labour rights. Discussions with legal experts have touched upon themes like freedom of association for all workers, including atypical workers; the impact of competition law on collective bargaining on behalf of atypical workers; the potential role of competition law in addressing power imbalances in the sectoral labour market; an inclusive definition of worker to capture new forms of work, etc. This blog will is intended to as a forum to capture reflections on these topics and bring together ideas and legal thinking relevant to the labour representation of the workers in our sector.<\/p>\n

Ce blog<\/a> est une initiative des f\u00e9d\u00e9rations syndicales du secteur des M\u00e9dias, des Arts et du Diverstissement, qui sont les partenaires sociaux europ\u00e9ens repr\u00e9sentant les travailleurs de ce secteur en Europe et au-del\u00e0. Il s’agit d’un secteur o\u00f9 les “travailleurs atypiques” constituent une partie importante du march\u00e9 du travail.<\/p>\n

Il est courant dans le secteur, du fait des productions et donc du travail bas\u00e9s sur des projets ainsi que du large \u00e9ventail et de la diversit\u00e9 des travailleurs impliqu\u00e9s dans un projet donn\u00e9, que les travailleurs accumulent des contrats, souvent de courte dur\u00e9e et aient une vari\u00e9t\u00e9 de statuts d\u2019emploi. Le concept de “travailleurs atypiques” inclut les travailleurs qui ne sont pas embauch\u00e9s de mani\u00e8re conventionnelle avec un contrat de droit du travail, mais en vertu du droit civil ou commercial. Il implique \u00e9galement ceux qui travaillent dans le cadre de dispositions contractuelles \u00e0 court terme et \u00e0 temps partiel, qu’il s’agisse d’un contrat de travail ou de prestation de services. Selon le contexte national, il s’agit de diff\u00e9rents types de travailleurs, tels que les travailleurs ind\u00e9pendants \u00e0 leur propre compte (sans employ\u00e9s), les travailleurs engag\u00e9s sous contrat d’auteur, etc. Ces travailleurs constituent une partie essentielle de la main-d’\u0153uvre du secteur et sont tr\u00e8s flexibles et hautement qualifi\u00e9s. Pourtant, ils restent trop souvent vuln\u00e9rables et insuffisamment couverts par les protections offertes aux travailleurs par le droit du travail et les conditions n\u00e9goci\u00e9es collectivement. Pour les syndicats, ils constituent un groupe essentiel, mais parfois difficile \u00e0 atteindre.<\/p>\n

Ces derni\u00e8res ann\u00e9es, nous avons d\u00e9velopp\u00e9 une r\u00e9flexion continue dans le cadre de nos projets communs sur la mani\u00e8re dont les syndicats peuvent repr\u00e9senter utilement cette main-d’\u0153uvre et faire respecter ses droits du travail. Les discussions avec les experts juridiques ont abord\u00e9 des th\u00e8mes tels que la libert\u00e9 d’association pour tous les travailleurs, y compris les travailleurs atypiques ; l’impact du droit de la concurrence sur la n\u00e9gociation collective au nom des travailleurs atypiques ; le r\u00f4le potentiel du droit de la concurrence dans le r\u00e8glement des d\u00e9s\u00e9quilibres de pouvoir sur le march\u00e9 du travail du secteur ; une d\u00e9finition inclusive de travailleur pour saisir les nouvelles formes de travail, etc. Ce blog est pens\u00e9 comme un forum pour recueillir les r\u00e9flexions sur ces sujets et rassembler les id\u00e9es et les r\u00e9flexions juridiques relatives \u00e0 la repr\u00e9sentation des travailleurs de notre secteur.<\/p>\n
